FICSA has organized an Appeals Training Workshop on employment disputes in the UN justice system which will take place at the WMO in Geneva on 25 and 26 September and will run from 09h30 to 17h00 on both days.

The workshop will be presented in English by Attorney Laurence Fauth, a FICSA Legal Advisor, and is open to staff representatives and participants irrespective of their duty station of assignment.

Purpose of the workshop

The new UN justice system was implemented with effect on 1 July 2009. The new system, created in response to the findings of the General Assembly’s “Redesign Panel” that the existing peer review system (Joint Appeals Board and Joint Disciplinary Committee) did not comply with fundamental notions of due process, abolished the JAB and JDC. It also abolished the United Nations Administrative Tribunal.

The UN adopted a two-tier appeal system similar to many domestic jurisdictions with a first instance Dispute Tribunal (a trial court) and a second level Appeals Tribunal (an appellate court). In marked contrast to the old system, appeals to the Dispute Tribunal are heard and decided by a professionally trained judge. In addition, both parties may appeal the decision issued by the Dispute Tribunal to the Appeals Tribunal. Appeals may be filed, depending on the duty station of the staff member, with the Dispute Tribunal in New York, Geneva, or Nairobi. The Appeals Tribunal is located in New York.

The workshop is designed to introduce staff representatives to the new UN Justice System and its jurisprudence. In addition to covering the statutes and procedural rules of both Tribunals, the workshop will explore and analyse the law applicable to various administrative decisions (abolition of post, selection, promotion, non-extension, termination, etc.) and the practical steps and strategies for pursuing effective appeals.

Participation fees

  • Please note that these workshops are offered free-of-charge to staff representatives from FICSA dues-paying members. *
  • A fee of CHF 300 is charged for other participants, including staff representatives from non-FICSA member organizations.
  • A 30% discount is applied to FICSA members with consultative and observer status.

Accommodation and general information

Participants will receive, upon confirmation of their participation, the provisional agenda and a general information document which will also include information on hotel accommodation in Geneva.

Seats are limited and will be confirmed on a first-come first-served basis, irrespective of the duty station of assignment. Therefore, to avoid disappointment, it is advisable to register well in advance of the deadline.

It is important to note that filing an application to participate in this workshop does not imply an automatic acceptance. You are therefore kindly requested to wait for the official confirmation before making any travel arrangements.

ALL TRAVEL RELATED EXPENSES AND DSA MUST BE FUNDED BY THE INDIVIDUAL STAFF ASSOCIATION/UNION OR ADMINISTRATION. FICSA cannot provide any financial assistance in this respect.
